Reconceptualizing Study in Educational Discourse and Practice

Addressing studying as a distinct educational concept and phenomenon in its own right, the essays in this volume consider study and studying from a range of perspectives. Countering dominant educational discourses, which place a heavy emphasis on learning and instruction, the contributors explore questions such as: What does it mean to study something? How is studying something different from being taught about it, or learning something about it? What does the difficulty demanded by study mean for the one who studies and for the teacher? What mode of existence does study induce? The book highlights the significance of study not only, or even primarily, for its educational outcome, but as a human activity.

International Criminal Law

Cases and Materials

International Criminal Law provides a set of teaching materials furnishing students with a grounding in the transnational issues likely to arise in federal criminal cases, and also in the law produced as a consequence of international efforts to impose criminal responsibility on the perpetrators of human rights atrocities through global mechanisms, such as the International Criminal Court. International Criminal Law offers, for teaching purposes, a collection of cases (mainly domestic) and other materials (both domestic and international), together with notes and questions about those cases and materials. The fifth edition begins with an examination of the scope of international criminal law, including consideration of the various sources of this law. Students are then introduced to important international criminal law doctrines and concepts before examining the various principles of jurisdiction that form the basis for the application of domestic and international law. Following these introductory materials, International Criminal Law focusses on a crafted selection of criminal enforcement areas with both domestic and international applications, including bribery, antitrust and securities regulation, export controls, computer crimes, narcotics and money laundering, piracy, terrorism, torture, and human trafficking. In examining these areas of enforcement, the book considers the domestic statutory landscape, the extraterritorial application of domestic statutes, and, where appropriate, the manner in which international laws, conventions, and norms address the topics from a global perspective. In examining bribery, for example, the chapter considers both the U.S. Foreign Corrupt Practices Act and international equivalents and agreements in this space, such as the U.K. Bribery Act and OECD Convention. International Criminal Law then immerses students in procedural law and policy related to international criminal law. This portion of the book considers the extraterritorial application of the U.S. Constitution, immunities from jurisdiction, international evidence gathering procedures, extradition, abduction, deportation, prisoner transfer, post-conviction issues, and international human rights covenants and conventions and their impact on criminal procedure. Finally, International Criminal Law introduces students to the four crimes of most concern to the international community--Aggression, Genocide, Crimes Against Humanity, and War Crimes. The book also examines the various courts and mechanisms used to bring those accused of these atrocities to justice, beginning with the Nuremberg and Tokyo precedents. Examination of these early forms of international tribunal are followed by materials examining more recent courts and mechanisms, including the International Criminal Court, Ad Hoc tribunals, hybrid tribunals and other creative variations. The new fifth edition includes important updates in the field, along with an expanded discussion of human trafficking and a new dedicated chapter on organized crime.

Futures of International Criminal Justice

This collection identifies and discusses problems and opportunities for the theory and practice of international criminal justice. The International Criminal Court and project of prosecuting international atrocity crimes have faced multiple challenges and critiques. In recent times, these have included changes in technology, the conduct of armed conflict, the environment, and geopolitics. The mostly emerging contributors to this collection draw on diverse socio-legal research frameworks to discuss proposals for the futures of international criminal justice. These include addressing accountability gaps and under-examined or emerging areas of criminality at, but also beyond, the International Criminal Court, especially related to technology and the environment. The book discusses the tensions between universalism and localisation, as well as the regionalisation of international criminal justice and how these approaches might adapt to dynamic organisational, political and social structures, at the ICC and beyond. Risikomanagement im Islamic Banking: Sukuk als Instrument zur Reduzierung des Liquiditätsrisikos islamischer Banken

Das Islamic Banking zählt heute zu den größten Wachstumsmärkten der globalen Finanzwirtschaft. Es weist jährliche Wachstumsraten von ca. 15 Prozent auf. Sowohl die steigende Nachfrage von Muslimen nach schariakonformen Finanzprodukten als auch die steigende Nachfrage von Investoren auf der ganzen Welt führen dazu, dass das Islamic Banking zu einem globalen Phänomen wird. Auch die aktuellen wirtschaftlichen Ereignisse und ihre Auswirkungen auf die globalen Finanzmärkte tragen dazu bei, dass sich die islamkonformen Finanzgeschäfte als eine Alternative zum konventionellen Bankenwesen entwickeln. An den beeindruckenden Wachstumsraten sowie an dem hohen Marktpotenzial partizipieren, neben islamischen Ländern und deren Banken, ebenso viele asiatische und europäische Länder mit ihren global tätigen Großbanken. Trotz des starken Wachstums sind mit dem Islamic Banking auch Herausforderungen verbunden, die es zu lösen gilt, damit der Markt weiter expandieren kann. Eine besondere Herausforderung für islamische Banken stellt das Risikomanagement dar. Islamische Banken sind in Abgrenzung zu konventionellen Banken, wegen der Prinzipien des Islamic Banking und den darauf aufbauenden Produkten und Dienstleistungen, spezifischen Risiken ausgesetzt, wodurch sich das Risikomanagement anspruchsvoller gestaltet. Das Ziel der vorliegenden Arbeit ist es zu analysieren, inwieweit die Sukuk dafür geeignet sind, das Liquiditätsrisiko islamischer Banken zu reduzieren.
