Berdasarkan Pasal 5 UU No. 1 Tahun 1946 jo. UU No. 73 Tahun 1958 yang merupakan “milestone” perkembangan hukum pidana Indonesia dengan “margin of appreciation and legitimation” yang di dasarkan atas penyesuaian terhadap kedudukan RI sebagai negara merdeka atau seluruhnya atau sebagian tidak dapat dilaksanakan atau tidak mempunyai arti lagi, maka dalam pembaharuan hukum pidana melalui RUU KUHP yang memiliki misi utama “Rekodifikasi Terbuka” pembenaran pembaharuan didasarkan atas Ideologi Pancasila, UUD NRI Tahun 1945, HAM dan asas-asas hukum umum yang diakui oleh bangsa-bangsa beradab. Dalam hal ini aspirasi suprastruktural, infrastruktural, kepakaran dan aspirasi global sangat dipertimbangkan. Dalam proses tersebut penulis selalu mempertimbangkan pentingya semangat hukum (legal spirits) yang mendasari eksistensi suatu produk perundang-undangan pidana, yang harus dirumuskan dengan baik dan akurat. Tanpa pemahaman terhadap semangat hukum ini (yang tersurat dan tersirat dalam Rancangan Akademis, Konsiderans Undang-undang dan Penjelasan Umum Undang-undang) dan semata-mata hanya mendasarkan pada norma-norma batang tubuh dan substansi serta penjelasan pasal demi pasal suatu undang-undang, penegakan hukum tidak akan memadai hasilnya, karena semangat hukum selalu tidak “value free”, khususnya terkait dengan rezim politik yang berkuasa saat Undang-undang dibuat.

Gelombang revolusi dalam teknologi digital yang terus berkembang dengan pesat telah mengubah wajah dunia. Jika dibandingkan dengan sektor lain, kemajuan teknologi digital ini berjalan lebih gesit dan penuh inovatif. Dari aspek yang sederhana saja, dewasa ini jumlah orang yang memiliki telepon seluler (ponsel) mungkin jauh lebih besar daripada mereka yang memiliki akses terhadap listrik atau air bersih. Difusi gelombang teknologi digital telah merangkak masuk ke semua aspek kehidupan dan ekonomi masyarakat dunia, seperti transportasi, kesehatan, pendidikan, ritel, hotel, dan bahkan keuangan. Dalam sektor keuangan, inovasi teknologi sebenarnya bukan merupakan fenomena baru. Antara teknologi dan keuangan, keduanya memiliki sejarah simbiosis mutualisme yang panjang, sehingga secara inheren teknologi keuangan (financial technology), juga bukan merupakan pengembangan baru bagi industri jasa keuangan. Meskipun demikian, intensitas pembahasan dan kajian tentang keduanya cukup tinggi akhir-akhir ini, terutama karena penetrasi fintech itu sangat cepat. Isu tersebut menjadi perhatian banyak pihak pada berbagai level di Indonesia, baik di kalangan pengambil keputusan, akademisi, dan praktisi bisnis keuangan maupun di tingkat publik (masyarakat) sebagai konsumen atau pengguna fintech. KEY ISSUES Context. Mauritania’s economy has benefited from macroeconomic stability and high growth in the context of contained inflation, responsible macro-policies, high iron ore prices and scaled-up public investment. However, economic growth has not translated into broadly improved living standards and is being hit by a sharp decline in iron ore prices. Outlook and Risks. Although the outlook remains favorable, it hinges heavily on stabilizing iron ore prices and expanding mining capacity. Downside risks to the outlook dominate because iron ore prices may decline further in response to excess supply in the global market. Key Policy Recommendations. With high risk of debt distress and deteriorating terms of trade, Mauritania’s fiscal policy needs to remain focused on consolidation to support fiscal sustainability. Over the medium term, a fiscal framework with a full-fledged fiscal rule will help prevent the boom–bust cycles that ensue from volatility in natural resource revenue, and with strengthened governance in managing mining wealth. The central bank should take advantage of the low-inflation environment to strengthen monetary policy formulation, gradually liberalize the foreign exchange market, and introduce liquidity support and banking resolution frameworks. The implementation of the recent FSAP recommendations should be pursued to enhance the stability of the financial sector stability. Economic diversification and inclusive growth are the foremost medium-term challenges. The authorities should accelerate structural reforms needed to raise Mauritania’s potential growth, create jobs, and improve living standards for all Mauritanians. Article VIII. Volume 11, the sixth of the historical volumes of A Treatise of Legal Philosophy and General Jurisprudence, offers a fresh, philosophically engaged, critical interpretation of the main currents of jurisprudential thought in the English-speaking world of the 20th century. It tells the tale of two lectures and their legacies: Oliver Wendell Holmes, Jr.’s “The Path of Law” (1897) and H.L.A. Hart’s Holmes Lecture, “Positivism and the Separation of Law and Morals” (1958). Holmes’s radical challenge to late 19th century legal science gave birth to a rich variety of competing approaches to understanding law and legal reasoning from realism to economic jurisprudence to legal pragmatism, from recovery of key elements of common law jurisprudence and rule of law doctrine in the work of Llewellyn, Fuller and Hayek to root-and-branch attacks on the ideology of law by the Critical Legal Studies and Feminist movements. Hart, simultaneously building upon and transforming the undations of Austinian analytic jurisprudence laid in the early 20th century, introduced rigorous philosophical method to English-speaking jurisprudence and offered a reinterpretation of legal positivism which set the agenda for analytic legal philosophy to the end of the century and beyond. A wide-ranging debate over the role of moral principles in legal reasoning, sparked by Dworkin’s fundamental challenge to Hart’s theory, generated competing interpretations of and fundamental challenges to core doctrines of Hart’s positivism, including the nature and role of conventions at the foundations of law and the methodology of philosophical jurisprudence.
