Analysis of Shariah and Legal Issues in BBA and Musharakah Mutanakisah

The Muslim population in many parts of the world has been growing significantly over the years. The demand for home loans has increased and Many Muslims by the day are turning their attention to Shariah compliant Home financing. In the case of Malaysia, Islamic home financing was first offered in 1983 with the establishment of Bank Islam Malaysia Berhad. The home financing scheme at that time was based On BBA or deferred payment sale. Ever since, BBA has become popular with Muslims in Malaysia, wanting to buy property through shariah compliant Financing. As a result the BBA concept accounts for the largest share of Islamic Home Financing offered by Islamic Banks presently. Nevertheless over the last few years there has been a lot of controversy surrounding BBA in Malaysia especially after the high court ruling In July2008wherein the application of the BBA contracts in the case of Arab Malaysian Finance Berhad V Taman Ihsan Jaya & Others (2008) was rendered to be contrary to the Islamic Banking Act 1983 (IBA). As a result opponents of BBA have suggested the use of Musharakah Mutanakisah as a viable alternative to BBA home financing. A few banks in Malaysia have started implementing the concept of Musharakah Mutanakisah for Home Financing. In this thesis the researcher aims at ascertaining whether the present practice of Musharakah Mutanakisah serves as a viable alternative to BBA. In doing so, the researcher has scrutinized the legal documentation of BBA and MM form various banks and raised all possible shariah issues pertaining to the legal documentation. A survey has been conducted in order to evaluate the students' perception of BBA and Musharakah Mutanakisah. In light of all shariah issues raised in the legal documentation of BBA and Musharakah Mutanakisah, the researcher fmally proposes a few solutions to the issues raised .

Metodologi Penelitian Bisnis

Dalam tiga dekade terakhir buku ini ditulis, lingkungan bisnis mengalami banyak perubahan secara dramatis. Supaya seorang manajer makin lama pandai, ia makin memerlukan lebih banyak informasi. Misalnya, ada pertumbuhan teknologi yang dahsyat dan inovasi yang masih berlangsung terus di bidang komunikasi global. Perubahan-perubahan ini telah menciptakan kebutuhan akan pengetahuan baru bagi manajer. Kecenderungan ke arah kompleksitas proses pengambilan keputusan meningkatkan risiko yang berkaitan dengan keputusan tersebut. Para manajer harus memiliki informasi yang lebih banyak dan lebih baik sebagai dasar untuk pengambilan keputusan. Manajer harus mempunyai dasar informasi atau datebase yang dapat dipercaya. Juga dia harus sungguh-sungguh mengerti metode-metode ilmiah dan menggunakannya dalam proses mengambil keputusan. Manajer harus tahu perbedaan antara penelitian yang baik dan penelitian yang kurang baik. Teks buku ini juga akan menghadapi lingkungan bisnis yang makin lama makin rumit atau kompleks sehingga manajer harus pandai menggunakan alat-alat yang dapat digunakan untuk melaksanakan penelitian.

Dalam tiga dekade terakhir buku ini ditulis, lingkungan bisnis mengalami banyak perubahan secara dramatis.

The Histamine H3 Receptor

A Target for New Drugs

In the early eighties when the H3 receptor was identified, many thought that an H3 ligand, an agonist or an antagonist, would become available as a therapeutic agent. This has not occurred. The reason for this could be the fact that many investigators consider histamine mainly, if not only, as a mediator present in for example mast cells being released during allergic events. However, it has become apparent that histamine is an important neurotransmitter. Its role in the nervous system, especially in the central part of it, is rather extensive. The H3 receptor is mainly found as a presynaptic one, both on histaminergic neurons (the auto-type) and on other neuronal systems (the hetero-type). Both the H3 agonist and the H3 antagonist cause important pharmacological effects. Several ligands have become available now, including radiolabelled analogues. In this book, the current state of affairs with regards to the medicinal chemistry and pharmacology of the H3 receptor and the several ligands available are presented by a number of experts in the field. The book presents an extended review of what has happened since the first H3 paper appeared. The editors hope that publication of this work will lead to an increase in interest of both academia and industry for the H3 receptor, especially as a target for drug development.

In this book, the current state of affairs with regards to the medicinal chemistry and pharmacology of the H3 receptor and the several ligands available are presented by a number of experts in the field.
