Taxing Profit in a Global Economy

The international tax system is in dire need of reform. It allows multinational companies to shift profits to low tax jurisdictions and thus reduce their global effective tax rates. A major international project, launched in 2013, aimed to fix the system, but failed to seriously analyse the fundamental aims and rationales for the taxation of multinationals' profit, and in particular where profit should be taxed. As this project nears its completion, it is becomingincreasingly clear that the fundamental structural weaknesses in the system will remain. This book, produced by a group of economists and lawyers, adopts a different approach and starts from first principles in order to generate an international tax system fit for the 21st century. This approach examines fundamental issues of principle and practice in the taxation of business profit and the allocation of taxing rights over such profit amongst countries, paying attention to the interests and circumstances of advanced and developing countries. Once this conceptual framework is developed, the book evaluates the existing system and potential reform options against it. A number of reform options are considered, ranging from those requiring marginal change to radically different systems. Some options have been discussed widely. Others, particularly Residual Profit Split systems and a Destination Based Cash-Flow Tax, are more innovative and have been developed at some length and in depth for the first time in this book. Their common feature is that they assign taxing rights partly/fully to the location of relatively immobile factors: shareholders or consumers.

Lahirnya Hukum Pidana Internasional (HPI) sebagai cabang tersendiri dari hukum internasional ditandai dengan pendirian Mahkamah Militer Internasional pasca Perang Dunia II untuk menuntut pelaku kejahatan yang luar biasa dan menghapuskan impunitas. Hal ini merupakan terobosan baik dalam hukum internasional maupun hukum pidana. Sebelumnya, hanya negara yang dapat dipertanggungjawabkan atas pelanggaran hukum internasional dan hanya negara yang berwenang melakukan penuntutan kepada pelaku, Sifat dari kejahatan yang luar biasa atau yang kerap diistilahkan sebagai kejahatan internasional inti menjadi hal penting karena memberikan otorisasi HPI untuk melaksanakan fungsi penuntutannya baik di tingkat nasional maupun internasional. Sayangnya, penerimaan universal negara terhadap kejahatan internasional inti tidak disertai dengan pengakuan adanya kewajiban penuntutan bagi pelakunya. Praktik amnesti dan pengakuan kekebalan absolut kepala negara masih menjadi hambatan diadilinya pelaku di tingkat nasional sehingga melanggengkan impunitas. Norma universal yang melandasi HPI pada kenyataannya tetap memerlukan norma positivisme jika berhadapan dengan kewajiban penuntutan yang bersifat prosedural. Karena dalam praktiknya kewajiban ini tidak bersifat universal dan hanya mengikat negara sebagai pihak instrumen HPI.

This book focuses on how Islamic family law is interpreted and applied by judges in a range of Muslim countries – Sunni and Shi'a, as well as Arab and non-Arab. It thereby aids the understanding of shari'a law in practice in a number of different cultural and political settings. In Women and Muslim Family Laws in Arab States Lynn Welchman examines women's rights in Muslim family laws in Arab states across the Middle East while also surveying the public debates surrounding the issues. The author considers these new laws alongside older statutes to comment on the patterns and dynamics of change both in the texts of the laws, and in the processes through by which they are drafted and issued. She draws on original legal texts and explanatory statements as well as on extensive secondary literature particular to certain states for an insight into practice, and on; interventions by women's rights organizations and other parties to the debate in the press and in advocacy materials. Besides updating the previous chapters on family law matters, the book updates the global concern on the appropriate law when dealing with family related disputes in the 21st century. Gender equality is a modern ideal, which has only recently, with the expansion of human rights and feminist discourses, become inherent to generally accepted conceptions of justice. In Islam, as in other religious traditions, the idea of equality between men and women was neither central to notions of justice nor part of the juristic landscape, and Muslim jurists did not begin to address it until the twentieth century. The personal status of Muslim men, women and children continues to be defined by understandings of Islamic law codified and adapted by modern nation-states that assume authority to be the natural prerogative of men, that disadvantage women and that are prone to abuse. This volume argues that effective and sustainable reform of these laws and practices requires engagement with their religious rationales from within the tradition. Gender and Equality in Muslim Family Law offers a groundbreaking analysis of family law, based on fieldwork in family courts, and illuminated by insights from distinguished clerics and scholars of Islam from Morocco, Egypt, Iran, Pakistan and Indonesia, as well as by the experience of human rights and women s rights activists.
