Mainstreaming Therapeutic Jurisprudence in Family Law

‎The Israeli Child Protection Law as a Case Study ‎

This Article considers the contribution of Therapeutic Jurisprudence (TJ) to the theoretical ‎development and practical advancement of reforms in child care law. It does so by presenting ‎three dilemmas arising from The Israeli Youth Law (Care and Supervision) - 1960 relating to its ‎substance, procedures, and practice. TJ is a “field of enquiry” that examines the influence of the ‎law on litigants in order to advance rules and practices that have therapeutic effects and to ‎minimize the use of rules and practices that have anti-therapeutic ones. Following the TJ ‎methodology, we integrate psycho-social findings into the legal discussion. We also follow ‎Wexler's metaphoric framework portraying legal rules and structures as “bottles,” practices and ‎behaviors as “wine,” and social science knowledge as “vineyards” from which TJ-oriented ‎‎“wine” can be made. We propose some therapeutic “wine,” as well as legal reform to make the ‎child protection “bottle” more “TJ-friendly” for children and families.‎

A Case Study of the Solidarity Economy

There are many misconceptions and concerns regarding Islamic societies and how Muslim countries have failed to come up with their own localised solutions to socio-economic problems in dealing with poverty alleviation and societal development. This book explores why there is so much disconnect between spirituality and enterprise development in the world today, and how a part of the Islamic world, in fact located in Pakistan, can be part of the solution rather than being central to the problem. This book builds upon Ronnie Lessem and Alexander Schieffer’s theory of ‘integral dynamics’ which works through a fourfold rhythm of the GENE. Set against a mono-cultural perspective, the authors highlight the ever-increasing and deepening divide between Western and Islamic cultures. Through the course of the book, the authors use the transformational GENE (Grounding, Emergence, Navigation, Effect) rhythm developed by Lessem and Schieffer to take readers through the 4C (Call, Context, Co-creation and Contribution) process, articulated to CAREing-4-Society. They ground their call in Akhuwat’s community of Akhuwateers (donors, beneficiaries, borrowers, volunteers and replicators), to explore alternative models of spiritually based finance through an emerging SOUL-idarity paradigm. Furthermore, through these models and Akhuwat’s CARE (Community, Awareness, Research, Embodiment) process, they put forward that encouraging community activism, raising awareness around Islamic practices of Qard-e-Hasan, institutionalising their innovative research, and finally transforming and educating the community, will provide an alternative to microfinance for poverty alleviation. Showcasing an unconventional spiritual-financial solution, deeply immersed in spirituality and infused with local moral values and traditions, this book demonstrates how poverty can be alleviated in countries around the world, specifically, in developing Muslim countries.

A Case Study of HSBC ATM.

The Automated Teller Machine (ATM) is one type of innovation that can mechanically accept deposits, issue withdrawals, transfer funds between accounts, collect bills, and make small loans. This study aims at investigating the satisfaction levels of HSBC ATM cardholders (both staff and nonstaff) with respect to various aspects (promptness of card delivery, the performance of HSBC ATM, the service quality of ATM personnel etc.) of using HSBC ATM and their opinions on various other related issues (such as positive and inconvenient features of HSBC ATM, recommendation to improve the service quality etc.). This study is one type of exploratory research using convenience sampling technique where samples have been selected on the basis of convenience. Thus, projecting data beyond the sample is statistically inappropriate. This study only provides information for analyzing ATM scenario of HSBC. Though the samples were selected on a convenience basis and it may not represent the whole population, but still it is no less important for the HSBC management to consider the recommendations with due care for better customer service and for being in a better competitive position.

Risk Management in Islamic Banking

A Case Study in Lebanon

Islamic finance is emerging as a rapidly growing part of the financial sector in the Islamic and recently in non-Islamic countries. Risk management is a crucial element in Islamic banking due to the nature of its operations. This paper stud ies the risk management system of the Islamic banks operating in Lebanon. Partic ularly, a survey was conducted to assess the status of all Islamic banks in Leba non. A statistical approach was followed to evaluate the degree of adoption of t he recommendations set by the Islamic Financial Services Board (IFSB) and the Ba sel Committee on Banking Supervision (BCBS). Those recommendations include the princ iples related to the responsibilities of the board of directors in formulating a clear and comprehensive risk management strategy. They also tackle the tools us ed by these banks to identify, monitor, control, and mitigate the main types of risks. The data collected showed that the degree of adoption of these principles varies from one bank to another; however, in general, the Islamic banking indus try in Lebanon lacks important regulations and procedures related to risk manage ment.
