Mainstreaming Therapeutic Jurisprudence in Family Law

‎The Israeli Child Protection Law as a Case Study ‎

This Article considers the contribution of Therapeutic Jurisprudence (TJ) to the theoretical ‎development and practical advancement of reforms in child care law. It does so by presenting ‎three dilemmas arising from The Israeli Youth Law (Care and Supervision) - 1960 relating to its ‎substance, procedures, and practice. TJ is a “field of enquiry” that examines the influence of the ‎law on litigants in order to advance rules and practices that have therapeutic effects and to ‎minimize the use of rules and practices that have anti-therapeutic ones. Following the TJ ‎methodology, we integrate psycho-social findings into the legal discussion. We also follow ‎Wexler's metaphoric framework portraying legal rules and structures as “bottles,” practices and ‎behaviors as “wine,” and social science knowledge as “vineyards” from which TJ-oriented ‎‎“wine” can be made. We propose some therapeutic “wine,” as well as legal reform to make the ‎child protection “bottle” more “TJ-friendly” for children and families.‎

ETIKA BISNIS DALAM ISLAM (TEORI DAN APLIKASI)

Allah swt menjelaskan bahwa Rasulullah memiliki akhlak yang mulia, وَإِنَّكَ لَعَلَىٰ خُلُقٍ عَظِيمٍ / “Dan sesungguhnya kamu benar-benar berbudi pekerti yang agung.” (QS. 68: 4). Berikutnya Allah swt berfirman: “Sungguh, telah ada pada (diri) Rasulullah itu suri teladan yang baik bagimu (yaitu) bagi orang yang mengharap (rahmat) Allah dan (kedatangan) hari Kiamat dan yang banyak mengingat Allah.” (QS. 33: 21). Kedua aayat tersebut menjelaskan bahwa, Rasulullah saw memiliki akhlak yang agung dan ummat manusia agar meraih kesuksesan dalam hidupnya, termasuk dalam kegiatan bisnis mereka, hendaknya mengikuti atau beruswah dan berqudwah kepadanya dan juga kepada para Nabi lainnya. Hal ini sejalan dengan firman Allah: “Sungguh, pada kisah-kisah mereka itu terdapat pengajaran bagi orang yang mempunyai akal. (Al-Qur'an) itu bukanlah cerita yang dibuat-buat, tetapi membenarkan (kitab-kitab) yang sebelumnya, menjelaskan segala sesuatu, dan (sebagai) petunjuk dan rahmat bagi orang-orang yang beriman.” (QS. 12: 111). Dengan demikian bagi para pelaku bisnis, disamping harus memiliki bakat, minat, menguasai ilmu pengetahuan dan keterampilan, serta belajar dari pengalaman atau kasus-kasus yang terjadi dalam berbisnis, tidak kalah pentingnya adalah mengimplemantasikan dan mengintegrasikan etika/akhlak islami yang bersumber dari al-Quran, hadits dan pandangan para ahli dalam bisnis agar bisnis mereka berhasil, sukses, dan berkelanjutan.

International Maritime Business. Comparison of the German and the Greek maritime clusters

Seminar paper from the year 2014 in the subject Business economics - Business Management, Corporate Governance, grade: 2,3, Hamburg School of Business Administration gGmbH (Maritime School), language: English, abstract: The purpose of this paper is to analyze the differences and similarities among shipping firms in the German and the Greek maritime clusters. In this context, market, financial, organizational, human resources and management related issues are identified and discussed. The two major European players in the global shipping market, namely the German and the Greek shipping firms, are currently facing several enormous challenges. The impact of global economic downturn, the crisis in the main shipping sectors and the changes in the pattern of world trade all profoundly affect the maritime transport industry (De Monie, Rodrigue und Notteboom 2011). However the Greek shipping companies seem to manage their businesses in the crisis more successfully than their German competitors. Therefore a report on the differences and similarities among shipping firms in the German and the Greek maritime clusters is of high interest. Even though both players focus on different segments in the maritime markets, that have different rules and conditions, the main parameters and aspects of their businesses will be compared. The focus of this report lies on market, financial, organizational, management and human resources related issues. Since these issues mainly touch strategic management decisions, this report will not go to deeply into the operational aspects of the businesses such as using Key Performance Indicators (KPI ́s) or other methods and applications that would serve these types of issues. The use of KPI ́s would also demand the same source of their collection to have an objective analysis, but since both players operate on different markets, only a small proportion of their KPI ́s would be comparable. Furthermore this paper will focus purely on companies that operate ships. Hence, ports, hinterland-logistics, education- or administration-facilities belonging to the maritime cluster will not be taken into account. After the German and Greek shipping firms have been compared, the report will highlight aspects that differentiate the particular maritime clusters and conclude with similar short prospects both players likely will face in the future.
