Understanding Maqasid al-Shari’ah

A Contemporary Perspective

Dr. Musafir bin Ali al-Qahtani's work contributes to the ever growing body of scholarly literature in the field of maqasid al-Shari'ah (higher objectives of Islamic law). Understanding Maqasidal-Shari’ah calls for the development of a juridicial sense that is finely tuned to the higher objectives and purposes of Islamic rulings, the aims of which are the formulation of a new methodology in understanding the revealed texts and the reform of Muslim thought and its application. The author draws attention to the importance of understanding various levels of maqasid, including distinguishing between primary aims (al-maqasid al-asliyyah) and secondary aims (al-maqasid al-tabi'ah). Al-Qahtani asserts that a positive understanding of the objectives of the Shari'ah should produce affirming human and cultural developments in Muslim societies. The real strength of this work, however, is in the author's application of higher objectives and aims to different areas of jurisprudence, such as in deriving and issuing religious rulings (ifta'). and to important social issues and problems present in Muslim societies, such as extremism, jihad, commanding right and forbidding wrong, social change, crisis of Muslim thought, countering religious excessiveness, the need for recreation and leisure, citizenship and nation-belonging, spreading beauty and harmony in Islam, and the role of Muslim women in society.

Wholeness and Holiness in Education

An Islamic Perspective

Critically examining the Western, secular approach to formal education, the author contests the value of an education system focusing solely on the intellectual and physical aspects of human development. The methodological aim and structure of this approach are compared to those of Islam which Dr. Al Zeera notes gives credence to the importance of spiritual and religious factors, as well as scholarly ones, with the overall objective of forming whole and holy human being who, instead of resisting the paradoxes of life, uses their interrelatedness as a means of personal and societal development. One interesting factor examined within the broader framework of the study is the area of female spirituality, an element, which the author argues, is vastly under-represented in prevalent Islamic literature. This study is a holistic view of knowledge and a sociological discussion adopting an unconventional approach of using the author’s own personal experiences as the basis for debate and analysis. We are invited to enter the world of understanding and observation to experience for ourselves an unusual approach to dialectical thinking.

Rethinking Reform in Higher Education

From Islamization to Integration of Knowledge

The Reform in Higher Education in Muslim Societies is in sum a paradigm shift in perspective driven by important considerations including the aims of education itself. It may require reforming existing disciplines, inventing new ones, as well as working in conjunction with current knowledge(s) and discourses by taking effective account of the ethical, spiritual norms of Muslim society, the guiding principles that it operates under, which in turn mark the underlying basis of its makeup and spiritual identity. Rather than creating divisions, reform of Higher Education in Muslim Societies recognizes the plurality and diversity of the modern networked world, and seeks to replace sterile and uniform approaches to knowledge with a broader and more creative understanding of reality as lived on different soils and different cultures. Moderation, balance and effective communication are paramount features of the underlying philosophy.

Some Basic Reflections

Towards a Fiqh for Minorities is an important subject and a much needed contribution to an area of fiqh that has become essential for the wellbeing and development of Muslim communities living in the West. The author stresses that the problems of Muslim minorities can only be tackled with a fresh juristic vision based on the principles, objectives and higher values of the Qur’an in conjunction with the ultimate aims and intents (maqasid) of the Shariah. In essence Dr. Al-Alwani’s paper is a call for Muslim minorities to have a sense of themselves as citizens and develop a positive, confident view of their place and value in society, moving away from notions of immigrant status and governed by a humanistic vision focusing on the betterment of society.

Current applications (or rather, misapplications) of Islamic law are reductionist rather than holistic, literal rather than moral, one-dimensional rather than multidimensional, binary rather than multi-valued, deconstructionist rather than reconstructionist, and causal rather than teleological. There is lack of consideration and functionality of the overall purposes and underlying principles of the Islamic law as a whole. Further, exaggerated claims of ‘rational certainty’ (or else, ‘irrationality’) and ‘consensus of the infallible’ (or else, ‘historicity of the scripts’) add to lack of spirituality, intolerance, violent ideologies, suppressed freedoms, and authoritarianism. Thus, a maqasidi approach takes juridical issues to a higher philosophical ground, and hence, overcomes (historical) differences over politics between Islamic schools of law, and encourages a much-needed culture of conciliation and peaceful coexistence. Moreover, the realization of purposes should be the core objective of all fundamental linguistic and rational methodologies of ijtihad, regardless of their various names and approaches. Thus, the validity of any ijtihad should be determined based on its level of achieving ‘purposefulness,’ or realizing maqasid al-shari’ah.
