The Politics of Education Policy in an Era of Inequality

Possibilities for Democratic Schooling

In a context of increased politicization led by state and federal policymakers, corporate reformers, and for-profit educational organizations, The Politics of Education Policy in an Era of Inequalityexplores a new vision for leading schools grounded in culturally relevant, advocacy, and social justice leadership theories. This timely volume tackles the origins and implications of growing accountability for educational leaders and reconsiders the role educational leaders should and can play in education policy and political processes. Examining the structural, political, and cultural interactions among school principals, district leaders, state, and federal policy actors, this text provides practical and aspiring leaders with the theoretical framework and practical strategies for building bridges between education researchers, practitioners, and policymakers.

Education Policy Analysis for a Complex World

Poststructural possibilities

In the past decade, post-structural policy analysis in education has evolved, primarily focusing on disrupting dominant narratives about education policy research, development and implementation, and the aims and outcomes of the policy-research nexus. This book originates from an ‘Education Policy Analysis for a Complex World’ workshop held in conjunction with the University of British Columbia and sponsored by a Canadian Social Sciences and Humanities Research Council Connection Grant. The workshop focused on one over-arching question: To what extent can post-structural theories offer innovative policy analyses, and contribute to new forms of policy development and implementation? The chapters in this collection provide responses from the participants of the workshop, and serve as illustrations of the broad range of scholarship that may be identified as post-structural policy analysis. This book was originally published as a special issue of Critical Studies in Education.

A Matter of Interpretation

Federal Courts and the Law - New Edition

We are all familiar with the image of the immensely clever judge who discerns the best rule of common law for the case at hand. According to U.S. Supreme Court Justice Antonin Scalia, a judge like this can maneuver through earlier cases to achieve the desired aim—"distinguishing one prior case on his left, straight-arming another one on his right, high-stepping away from another precedent about to tackle him from the rear, until (bravo!) he reaches the goal—good law." But is this common-law mindset, which is appropriate in its place, suitable also in statutory and constitutional interpretation? In a witty and trenchant essay, Justice Scalia answers this question with a resounding negative. In exploring the neglected art of statutory interpretation, Scalia urges that judges resist the temptation to use legislative intention and legislative history. In his view, it is incompatible with democratic government to allow the meaning of a statute to be determined by what the judges think the lawgivers meant rather than by what the legislature actually promulgated. Eschewing the judicial lawmaking that is the essence of common law, judges should interpret statutes and regulations by focusing on the text itself. Scalia then extends this principle to constitutional law. He proposes that we abandon the notion of an everchanging Constitution and pay attention to the Constitution's original meaning. Although not subscribing to the “strict constructionism” that would prevent applying the Constitution to modern circumstances, Scalia emphatically rejects the idea that judges can properly “smuggle” in new rights or deny old rights by using the Due Process Clause, for instance. In fact, such judicial discretion might lead to the destruction of the Bill of Rights if a majority of the judges ever wished to reach that most undesirable of goals. This essay is followed by four commentaries by Professors Gordon Wood, Laurence Tribe, Mary Ann Glendon, and Ronald Dworkin, who engage Justice Scalia’s ideas about judicial interpretation from varying standpoints. In the spirit of debate, Justice Scalia responds to these critics. Featuring a new foreword that discusses Scalia’s impact, jurisprudence, and legacy, this witty and trenchant exchange illuminates the brilliance of one of the most influential legal minds of our time.

Forty Hadith Qudsi

The Forty Hadeeth Qudsi (known as Sacred Hadeeth in English) is widely regarded as the most popular antology and the best introduction to the study of the Prophet’s (S) sayings. The Ahadeeth summarize the teachings of Islam, concentrating on the following areas; affirmation of the doctrine of Tawheed and understanding Allah (SWT) in all His attributes, the significance of the five pillars of Islam, attainment of virtue, self-sacrifice for the cause of Allah and preparation for the Day of Judgement. The Hadeeth Qudsi have a particularly important status because their meaning is entirely from Allah while the wording is that of the Prophet Muhammad (S) himself. Among the many definitions given by the early scholars of Islam is that of As-Sayyid Ash-Shareef Al-Jurjani (died 816 A.H.) in his lexicon At-Tarifat where he says: “A Sacred Hadeeth is, as to the meaning, from Allah the Almighty; as to the wording, it is from the Messenger of Allah (S). it is that which Allah the Almighty has communicated to His Prophet through Revelation or in a dream, and he (S), has communicated it in his own words.” So these are the sayings of the Prophet divinely communicated to him. The present collection has been compiled from all the available books of Hadeeth. The forty chosen here are well authenticated and present many of the doctrinal, devotional and ethical elements of Islam.
