Origins and Developments

Hadith is understood here in its broader meaning as the bulk of the texts which contain information on the prophet Muhammad and his Companions, having the form of transmissions from them. The reliability of this material as a source for early Islam is still a highly debated issue. This selection of articles presents the different points of view in this debate and the varying methodological approaches with which scholars trained in modern secular sciences have tried to find a solution to the problem.

In today’s complex and volatile world, the consequences of relying on fraudulent and counterfeit ‎Hadith to legitimize extremist behavior, issue violent fatwas, and justify blatant abuse, particularly ‎of women, is not only far too easy but in fact dangerous. Israr Khan addresses the sensitive topic of ‎Hadith authentication, focusing on the criteria adopted by classical scholars to maintain that ‎concentration on the continuity and accuracy of the chain of narrators, rather than the textual ‎content of Hadith, has led to particular Hadith being included which either contradict other Hadith ‎directly, project the Prophet (SAAS) in an uncharacteristic light, or do not reflect and/or conflict ‎with the teachings of the Qur’an. The study traces in careful detail the historical development of the ‎oral and written traditions, as well as the many targeted attempts at fabrication that took place, ‎critiquing in methodical detail certain Hadith which have come to be widely accepted as ‎‎“authentic.” The prominent collections we have today, were made possible by the development of ‎the science of Hadith criticism, and Muslim scholars deserve deep appreciation for their painstaking ‎work, as well as their invaluable contribution towards preserving the Hadith literature to the best of ‎their ability. The publication of The Formation of the Sunni Schools of Law, Ninth-Tenth Centuries C.E., first as a University of Pennsylvania doctoral dissertation in 1992, and subsequently as a monograph in 1997 (Studies in Islamic Law and Society, Brill), established Christoph Melchert as a preeminent scholar of the history of Islamic law and institutions. Through close readings of works on fiqh, meticulous unpacking of data in biographical dictionaries, and careful attention to curricular, pious, pedagogical, and scholarly practices, Melchert has subsequently illuminated the processes and procedures that undergirded the development of Islamic movements and institutions in the formative period of Islam. The present volume brings together sixteen of his articles, including those considered his most important as well as ones that are difficult to access. Originally published between 1997 and 2014, they are arranged chronologically under three rubrics-hadith, piety, and law. The material is presented in a new format, updated by Melchert where appropriate, and indexed. The appearance of these articles together in a single volume makes this book a highly significant and welcome contribution to the field of classical Islamic Studies.

Woman's Identity and Rethinking the Hadith

The Prophet Muhammad’s reported traditions have evolved significantly to affect the social, cultural, and political lives of all Muslims. Though centuries of scholarship were spent on the authentication and trustworthiness of the narrators, there has been less study focused on the contents of these narratives, known as Hadith or Sunnah, and their corroboration by the Qur`an. This book is a first step in a comprehensive attempt to contrast Hadith with the Qur`an in order to uncover some of the unjust practices by Muslims concerning women and gender issues. Using specific examples the author helps the reader appreciate and understand the magnitude of the problem. It is argued that the human rights and the human development of Muslim women will not progress in a meaningful and sustainable manner until the Hadith is re-examined in a fresh new approach from within the Islamic framework, shifting the discourse in understanding Islam from a dogmatic religious law to a religio-moral rational worldview. The author argues that such re-examination requires the involvement of women in order to affirm their authority in exegetical and practical leadership within Muslim societies, and she encourages Muslim women to stand up for their rights to effect change in understanding the role of sunnah in their own life.

This book is a first step in a comprehensive attempt to contrast Hadith with the Qur`an in order to uncover some of the unjust practices by Muslims concerning women and gender issues.
