The Present and Future of European Family Law explores the essence of European family law - and what its future may be. It compares and analyses existing laws and court decisions, identifies trends in legislation and jurisprudence, and also forecasts (and in some cases proposes) future developments. It establishes that while there is, at present, no comprehensive European family law, elements of an 'institutional European family law' have been created through decisions by the European Court on Human Rights and by the Court of Justice of the European Union as well as other EU instruments. At the same time an 'organic European family law' is beginning to emerge. The laws in many European jurisdictions have developed similarly and have 'grown together', not only as a result of the aforementioned institutional pressures, but also as a result of societal developments, and comparable reactions to medical and societal advances and changes. Redefining Family Law in India

This volume is a collection of articles by scholars across disciplines to create a discourse of family law independent of Religious Personal Law, whilst striving for fairness and justice to all. It demonstrates the artificiality of the public–private divide and seeks the systematic development of ideas for a fair and just family law in contemporary India. The book does not merely document the pathologies of power within the family but also makes proposals for remedying these inequities. It is not confined to considering what changes need to be inducted into existing family law to make it more just, but also strategises on the means and methods of effecting the change. It lifts the familial veil and scrutinises the status, rights and disabilities of some of the subordinated members of the family. The volume is an invitation to redefine family law with the twin tools of reflection and responsibility. Redefining Family Law in India

'Family Law' refers to the set of legal rules which are in practice in India with regards to 'family' issues - marriage, divorce, inheritance, etc. This volume is a collection of articles by different scholars across disciplines to generate a discourse on just Family Law. Main features: it is an inter-disciplinary collection of articles on family law - not just by lawyers or legal specialists but includes political scientists, sociologists, economists, anthropologists, religion specialists, etc. it is concerned with a just family law that moves beyond a uniform civil code. Has a strong but not exclusive focus on women and women's issues. The authors demonstrate that substantive rules such as a just family law, in addition to being inclusive, would make connections between the structure of the family and in the wider economic, political and social institutions. Secondly, they challenge the myths about the private sphere as the sphere of non-regulation by law in order to demonstrate that just a family law can be compatible with freedom of conscience. The authors here are seeking to create a discourse on family law that accommodates diversity and is context-sensitive. However, most of the contemporary legal theory questions the role of law in achieving justice, and there is a pervasive view that cultural diversity is more valuable than a state-imposed family law. This argument is addressed from various standpoints to show that cultural plurality can be pursued in many other ways and a just family law is the minimum condition for a fair resolution of disputes, if and when they do rise. This book does not just document the pathologies of power within the family but also makes proposals for remedying these inequities. It is not confined to considering what changes need to be inducted into existing family law to make it more just, but also strategises on the means and methods of effecting the change. Mainstreaming Therapeutic Jurisprudence in Family Law

‎The Israeli Child Protection Law as a Case Study ‎

This Article considers the contribution of Therapeutic Jurisprudence (TJ) to the theoretical ‎development and practical advancement of reforms in child care law. It does so by presenting ‎three dilemmas arising from The Israeli Youth Law (Care and Supervision) - 1960 relating to its ‎substance, procedures, and practice. TJ is a “field of enquiry” that examines the influence of the ‎law on litigants in order to advance rules and practices that have therapeutic effects and to ‎minimize the use of rules and practices that have anti-therapeutic ones. Following the TJ ‎methodology, we integrate psycho-social findings into the legal discussion. We also follow ‎Wexler's metaphoric framework portraying legal rules and structures as “bottles,” practices and ‎behaviors as “wine,” and social science knowledge as “vineyards” from which TJ-oriented ‎‎“wine” can be made. We propose some therapeutic “wine,” as well as legal reform to make the ‎child protection “bottle” more “TJ-friendly” for children and families.‎

ETIKA BISNIS DALAM ISLAM (TEORI DAN APLIKASI)

Allah swt menjelaskan bahwa Rasulullah memiliki akhlak yang mulia, وَإِنَّكَ لَعَلَىٰ خُلُقٍ عَظِيمٍ / “Dan sesungguhnya kamu benar-benar berbudi pekerti yang agung.” (QS. 68: 4). Berikutnya Allah swt berfirman: “Sungguh, telah ada pada (diri) Rasulullah itu suri teladan yang baik bagimu (yaitu) bagi orang yang mengharap (rahmat) Allah dan (kedatangan) hari Kiamat dan yang banyak mengingat Allah.” (QS. 33: 21). Kedua aayat tersebut menjelaskan bahwa, Rasulullah saw memiliki akhlak yang agung dan ummat manusia agar meraih kesuksesan dalam hidupnya, termasuk dalam kegiatan bisnis mereka, hendaknya mengikuti atau beruswah dan berqudwah kepadanya dan juga kepada para Nabi lainnya. Hal ini sejalan dengan firman Allah: “Sungguh, pada kisah-kisah mereka itu terdapat pengajaran bagi orang yang mempunyai akal. (Al-Qur'an) itu bukanlah cerita yang dibuat-buat, tetapi membenarkan (kitab-kitab) yang sebelumnya, menjelaskan segala sesuatu, dan (sebagai) petunjuk dan rahmat bagi orang-orang yang beriman.” (QS. 12: 111). Dengan demikian bagi para pelaku bisnis, disamping harus memiliki bakat, minat, menguasai ilmu pengetahuan dan keterampilan, serta belajar dari pengalaman atau kasus-kasus yang terjadi dalam berbisnis, tidak kalah pentingnya adalah mengimplemantasikan dan mengintegrasikan etika/akhlak islami yang bersumber dari al-Quran, hadits dan pandangan para ahli dalam bisnis agar bisnis mereka berhasil, sukses, dan berkelanjutan.
